Terms of Service
These terms govern your center's use of Lumidor.
1. The service
Lumidor is web-based therapy management software for child therapy centers. It provides scheduling, clinical goal tracking, session notes, parent communication, consent records and related administrative tools. Lumidor is a record-keeping and administrative tool. It does not provide clinical advice, does not make clinical decisions, and is not a medical device. Clinical judgement remains entirely with your qualified practitioners.
Lumidor is offered on an early-access basis. Features may change as the product develops. Where a change materially reduces functionality your center relies on, we will give you reasonable notice.
2. Accounts and your responsibilities
An account is issued to a center, which is responsible for everyone it invites. Your center agrees to:
- keep account credentials confidential and not share logins between people;
- give each staff member only the access their role requires, and remove access promptly when someone leaves;
- ensure the information entered is accurate, and that you have the lawful basis and consents needed to enter it;
- tell us promptly if you suspect unauthorised access to your account.
3. Acceptable use
Your center agrees not to:
- use Lumidor for any unlawful purpose, or to store data you have no right to hold;
- attempt to access another center's data, or probe, scan or test the security of the service without our written permission;
- reverse engineer, resell or white-label the service without a written agreement;
- upload malicious code, or use the service in a way that degrades it for others.
4. Your data belongs to your center
All records your center enters — children's details, clinical notes, goals, consents, documents and communications — remain your center's property. We claim no ownership of them.
We use your data only to provide and support the service. We do not sell it, do not share it with third parties for their own purposes, and do not use your clinical records to advertise to you or anyone else.
5. Data protection roles
For the purposes of India's Digital Personal Data Protection Act 2023, your center is the data fiduciary and Lumidor acts as a data processor processing personal data on your documented instructions. Determining what data is collected, why, for how long, and on what lawful basis — including verifying parental consent where children's data is involved — rests with your center.
We will assist you, so far as we reasonably can, with requests from parents to access, correct or erase data, and with your own security and notification obligations. If we become aware of a personal data breach affecting your center, we will notify you promptly. What we provide is described on our DPDP readiness page.
6. Availability and support
We work to keep Lumidor available and reliable, but during early access we do not offer a contractual uptime guarantee. Planned maintenance will be notified in advance where practical. Support is provided by email and WhatsApp during Indian business hours.
7. Fees
Fees are agreed with each center in writing before the service begins. We will give reasonable written notice before any change to fees applies to your center.
8. Limitation of liability
To the maximum extent permitted by law, Lumidor is not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or anticipated savings, arising out of your use of the service.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the fees paid by your center for the service in the twelve months preceding the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
Lumidor supports your record-keeping; it does not replace professional judgement. We are not liable for clinical decisions taken by your practitioners.
9. Termination and getting your data out
Your center may stop using Lumidor at any time. We may suspend or terminate an account for a material breach of these terms, giving reasonable notice and an opportunity to put things right where the circumstances allow.
Your data is yours. Request a complete export of your center's records at any time, and if you ever leave Lumidor, we provide everything in standard formats at no charge. Following termination we will retain your data for a reasonable period so you can complete an export, and will then delete it on your written request.
10. Changes to these terms
We may update these terms as the service develops. Where a change materially affects your center's rights, we will give reasonable notice. Continuing to use Lumidor after a change takes effect means the updated terms apply.
11. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
